1. Acceptance of Terms

By accessing or using the DanLabs website ("danlabs.me"), services, applications, or any associated content (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Service.

2. Description of Service

DanLabs provides full-stack web development, desktop application development, hardware engineering, cybersecurity auditing, branding, photography, and related digital services. We also offer subscription-based service plans and project-based engagements.

3. Account Registration

To access certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

You must be at least 18 years of age or the age of legal majority in your jurisdiction to create an account and use the Service.

4. Payments & Subscriptions

Certain services are offered on a subscription basis. By subscribing, you agree to:

• Pay all applicable fees as described at the time of purchase
• All payments are processed securely through our payment provider using industry-standard encryption
• Subscriptions auto-renew unless cancelled before the next billing period
• Refunds are handled on a case-by-case basis at our discretion
• Prices are in EUR (€) and may be subject to change with 30 days' notice

5. Intellectual Property

All content, designs, code, graphics, logos, and other materials on the Service are the intellectual property of DanLabs or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our explicit written consent.

For client projects: upon full payment, intellectual property rights for the delivered work transfer to the client as outlined in the specific project agreement.

6. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Upload or transmit malicious code, viruses, or harmful data
• Impersonate any person or entity
• Engage in any form of automated data collection without consent
• Attempt to reverse-engineer, decompile, or exploit the Service

7. Project Submissions

When submitting a project request through our platform, you acknowledge that:

• Submission does not guarantee acceptance of the project
• We reserve the right to decline any project at our discretion
• Information provided in submissions is accurate and truthful
• Project timelines and budgets are estimates and may vary

8. Limitation of Liability

To the maximum extent permitted by applicable law, DanLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you have paid to DanLabs in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

11. Communication & Marketing

By creating an account, you agree to receive:

• Transactional emails related to your account and services (e.g. order confirmations, security alerts, account notifications)
• Service announcements and critical updates affecting your account

Marketing Communications

During account registration, you may opt in to receive marketing communications including newsletters, promotional offers, feature announcements, and other commercial content. This consent is entirely optional and is not required to use the Service.

If you have opted in, you may withdraw your marketing consent at any time by:

• Clicking the "unsubscribe" link in any marketing email
• Updating your preferences in your account settings

You cannot opt out of transactional emails related to your account or active services, as these are necessary for the operation of the Service.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Malta and the European Union. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malta.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the Service. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
